3. Typographical Errors
In the event a product price is listed incorrectly due to typographical error, error or change in pricing information received from our vendors, Mercury Technologies shall have the right to refuse or cancel any orders placed for product listed at the incorrect price, regardless of whether the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase containing items that have been incorrectly priced, Mercury Technologies will either refund or charge you for the difference between the correct price of the products and incorrectly listed price for the products.

4. YOUR ACCOUNT
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are a child or under 21 years old, you may still purchase items from Mercury Technologies but only with the involvement of an adult or guardian. 6. Term of Use Revisions
Mercury Technologies may at any time revise these Terms of Use by updating this posting. By using this Site, you agree to be bound by any such revisions and should therefore periodically visit this page to determine the then current Terms of Use to which you are bound.

7. Title
Title to Products remains with Mercury Technologies until all amounts payable in respect of Products to Mercury Technologies by Customer is received in full by Mercury Technologies. Risk in Products shall pass from Mercury Technologies to Customer upon delivery of Products to Customer.

8. The Transaction

8.1 No contract shall exist until Customer's order is accepted by Mercury Technologies. This website is an Invitation to Treat. Orders which have been accepted shall have it's status updated to "Processing".
8.2 Notwithstanding Clause 8.1, , in the event that the Customer repudiates the contract ,after acceptance by Mercury Technologies, by cancelling or amending the order, Mercury Technologies may at its absolute discretion impose an administrative charge on the Customer for any loss occasioned by the repudiation.
8.3 Mercury Technologies has no obligation to deliver Products until the Price and any other applicable charges is received in full by Mercury Technologies in the currency in which the Price is quoted to Customer by Mercury Technologies or in the absence of such a quotation in the currency in which the Price appears in Mercury Technologies's price list on the date of the Agreement.
8.4 All stated promotional gifts given are subjected to availability and allocated on a first come first served basis.
8.5 Mercury Technologies reserves the right to refuse to accept an order from a Customer without reason or prior notice.
8.6 All orders are subjected to stock availability. Mercury Technologies reserves the rights not to fulfill or cancel an order in the event that stocks are unavailable.
8.7 The Customer is responsible for checking that the requirements for the product to function is met. Mercury Technologies will not take responsibility for products that cannot work due to the failure of such a requirement.

9. Cancellations
An administrative charge of 15% of the total cost of the order will be imposed for cancellations of orders which have been confirmed via e-mail or phone by the Customer. Such orders will have their status updated to "Processing".

10. Product Acceptance
Unless Customer notifies Mercury Technologies to the contrary by seven(7) days after the delivery of Products, products shall be deemed to have been accepted by Customer in good condition and in accordance with the Agreement.

12. Governance and Jurisdiction
This TOS shall be governed and construed in accordance with the laws of the Republic of Singapore and it is hereby irrevocably agreed for the exclusive benefit of Mercury Technologies that the courts of Singapore are to have exclusive jurisdiction to settle any disputes that may arise out of or in connection with The Service and that accordingly any writ, action, or proceeding arising out of or in connection with this TOS (hereinafter called "Proceedings") may be brought in such courts. Nothing in this clause shall limit the right of Mercury Technologies to take Proceedings against Users in any court of competent jurisdiction, nor shall the taking of Proceedings in one or more jurisdictions preclude the taking of Proceedings in any other jurisdictions, whether concurrent or not.
